General Terms and Conditions of Sale (GTC)

Article 1. Purpose

These General Terms and Conditions of Sale (GTC) define the contractual relationship between AQUAGOLD SAS, a company with a capital of €10,000, registered with the Paris Trade and Companies Register under number 93500568600016, headquartered at 50 Avenue des Champs-Élysées, 75008 Paris, hereinafter referred to as "AQUAGOLD SAS," and any professional buyer making a purchase via the website https://www.aquagoldfinetouch.eu.

Purchasing products on the website implies unreserved acceptance of these GTC. AQUAGOLD SAS reserves the right to modify these GTC at any time, with the applicable version being the one in effect on the date of order validation.

Article 2. Products

The products sold on the website are exclusively intended for professionals and include:

  • AQUAGOLD® 0.5mm: Cosmetic tool for professional use.
  • AQUAGOLD® Intensifier (0.2mm): Cosmetic tool for professional use.
  • Hyaluronic acid serums and other products listed in the online catalog.

Product descriptions are available on their respective product pages. Photographs are provided for illustrative purposes only and do not engage AQUAGOLD SAS's liability.

Article 3. Orders and Quotation Process

3.1 Requesting a Quote

Access to prices and orders is reserved for professionals with a company registration number (SIRET) or equivalent. To place an order, the Buyer must:

  • Create an online account and provide professional details.
  • Select products and submit a quotation request via the website.
  • Receive a detailed quotation by email.

The quotation is valid for 30 days from its issuance. Validation of the quotation implies acceptance of the GTC.

3.2 Order Confirmation

An order is confirmed upon receipt of:

  • The signed quotation from the Buyer.
  • Full or partial payment, as specified in the quotation.

AQUAGOLD SAS reserves the right to refuse any order if there are doubts about the Buyer’s payment ability or for any other justified reason.

Article 4. Pricing and Payment Terms

4.1 Prices

Prices are communicated via quotation and are expressed in euros (€), excluding taxes (HT). The applicable VAT is added at the time of invoicing.

4.2 Payment Methods

Payment can be made via:

  • Bank transfer.
  • Secure payment via Stripe.

No order will be shipped until full payment is received, or as per the terms of the quotation.

Article 5. Delivery

5.1 Delivery Areas

Deliveries are available in Europe, the United Kingdom, and Switzerland.

5.2 Shipping Costs and Delivery Times

Shipping costs and delivery times are specified in the quotation. Customs duties and taxes for the United Kingdom and Switzerland are the responsibility of the Buyer.

5.3 Inspection of Shipments

The Buyer must check the condition of the packages upon receipt and report any discrepancies to the carrier within three (3) business days.

Article 6. Retention of Ownership

AQUAGOLD SAS retains ownership of the products until full payment has been received.

Article 7. Warranties and Exclusions

  • Warranty is limited to product compliance.
  • Exclusion of liability for improper use of the products.

Article 8. Intellectual Property

  • Any reproduction of website content is strictly prohibited.
  • Protection of patents, trademarks, and copyrights.

Article 9. Liability and Force Majeure

  • Exclusion of liability in cases of force majeure.
  • Indemnification for misuse of products.

Article 10. Data Protection (GDPR Compliance)

  • Right to access and delete personal data.
  • Commitment not to sell customer data.

Article 11. Applicable Law and Disputes

  • French law applies in all cases.
  • The Court of Nice shall have jurisdiction over any disputes.
